Warranty Statement

WHAT IS A WARRANTY

A warranty is a specific period of time from the date of start-up that any defects in materials and workmanship are guaranteed. This warranty shall not apply to any such items that have been subjected to negligence, improper maintenance, chemical imbalance, improper operations, or willful abuse. Should you call for warranty service and the problem is a customer maintenance issue, you will be responsible for the costs of any and all repairs.

WHAT IS MY WARRANTY PERIOD?

1. Structure of shell – Lifetime of the original owner. Sunburst further warrants that the pool structure will remain structurally sound for the period of time that the pool is owned by the original owner. Tile, decking, planter walls, colors, plaster, plumbing, electrical, filter, heater and other pool accessories are, by definition, not part of the pool structure. The term "structurally sound" means that the swimming pool is capable of retaining water, and in the event of failure to do so Sunburst will within the stipulated period repair the structure so that it will hold water.
2. Caretaker Infloor – Lifetime on parts, 3 years on labor
3. Pebble tec & Pebble sheen – 5 years on material per manufacturer’s warranty
4. Ultra Poz – 7 years on materials per manufacturer’s warranty
5. 3M Quartz – 10 years on materials per manufacturer’s warranty
6. Plaster – 2 years
7. Equipment (Pumps, Filters, Heaters, Pool Vac) – 3 year bumper to bumper
8. Hayward Wireless Controls – 3 year bumper to bumper
9. Housing of Equipment – 10 years
10. Decking – 2 years
11. Trades (ie electrician, plumber etc.) – 2 years

LIMITED WARRANTY

THIS LIMITED WARRANTY IS GIVEN IN LIEU OF ALL WARRANTIES EXPRESS OR IMPLIED, IMPLIED WARRANTIES OF MERCHANTABLITLITY ARE HEREBY EXCLUDED AND THERE ARE NO WARRANITES WHICH EXTEND BEYOUND THE DESCRIPTION ON THE FACE HEREOF. ANY LIABLITY ON THE PART OF SUNBURST POOLS & SPAS IS LIMTED TO THE REMEDY OF THE DEFECT OR CONDITION.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

SUNBURST POOLS & SPAS, INC., provides the following Limited Warranty on your pool and equipment.

Conditions

This limited warranty shall be subject to the Owner complying with the following conditions.

1. The swimming pool shall be kept full of water at all times except for purposes of repair or maintenance not to exceed ten days
2. The swimming pool shall be used in a normal and reasonable manner and shall be operated in accordance with Sunburst Pools and Spas operation instructions

Material and Workmanship

All of the labor, materials and equipment used in the construction of your swimming pool are warranted to be free of defects for a period of 1 year from the date the pool is plastered. In the event the swimming pool, its equipment of appurtenances fail to perform in a normal and regular manner or develop a defect or malfunction, Sunburst Pools & Spas will replace or correct the defect at no expense to the owner.

Swimming Pool Shell

The swimming pool shell is warranted to remain structurally sound and capable of holding water for the period of time that the pool is owned by the original owner. Any failure of the shell to retain water shall be repaired so that will hold water, at no charge to the Owner.

Exceptions

No warranty extends to any part of the swimming pool, its equipment, or appurtenances there to which are caused by any of the following conditions or events.

1. Ordinary wear damages by elements, unusual abuse, neglect, incorrect operation or lack of care of the pool or equipment.
2. Substitution of equipment or service or addition of unauthorized equipment.
3. Concrete and plaster products by their inherent characteristics develop hairline checks and cracks and discolor and stain, and therefore will not be covered by this warranty except when such checks or cracks exceed the thickness of a dime.
4. Damage caused by surface or subterranean drainage under or around said pool or earth fill movement or expansive soil, explosions, wrecking, and the like, and not occasioned by Sunburst Pools & Spas.
5. Sunburst Pools & Spas expressly denies any responsibility or liability for incidental or consequential damages arising out of or as a result of the use of ownership of you swimming pool.

Performance

To obtain performance the Owner should contact Sunburst Pool & Spas Inc., at 2432 W. Peoria Ave, Ste 1300, Phoenix, Arizona 85029 or telephone (480)998-5848. Sunburst Pools & Spas, Inc., shall not be responsible for the replacement of water in the pool or chemicals used in treating said water or energy used to head said water as a result of performing any work under this Limited Warranty.

In the event Sunburst Pools & Spas, Inc.,, is requested to perform any work or service under this Limited Warranty and a service respresentative is sent to the pool site and it is determined that no service is required by this warranty, then the Owner shall be responsible to pay Sunburst Pools & Spas, Inc. a reasonable service fee for any such service call.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
